legal and ethical constraints
|
Constraint |
Describe
the details of constraint |
Explain
how the constraint
will directly impact on your work |
|
voice
artist release forms- Clearances
and permissions |
A talent release
form is a simple legal document that is
designed to prevent you from getting sued for the unauthorised use of someone's image or voice |
this
will impact us as it mean that we will need to create a voice release form
and give it to are voice actors before we start recording. |
|
PPL |
PPL is
a licences radio station, TV broadcast and certain digital media services to play recorded music
in the UK as part of their programming. This mean that they are the one
that allow for rights-holders to be able to play their music in public. |
This
won’t be an issue as we will not be using any music that is from a out side
source and all recoding will be done by us. |
|
PRS |
If I
someone were to play music in public and it contained offensive music without
a licence they can be given a fine. |
This will
not apply as the music that we are going to use will be made by us meaning
that their will be no copyright music used in our production |
|
Royalties |
The payments which PPL collects from businesses
and broadcasters, and then passes on to the performers and recording
rightsholders it represents, are sometimes
referred to as “royalties”. |
This
will not apply to us as we will not be using any copyright music during our
recording meaning that we will not be paying any royalty fees to any music
producing company |
|
Copyright |
Copyright is a bunch of rights in certain creative material such as
text, artistic works, music, computer programs, sound recordings and films. The copyright owner has the right to control how
their material is used. |
We
will not be using anyones creative material in our recording as all product
will be done from scratch and will not use any outside sources/Third parties
during production |
|
Offensive
content |
Offensive Content means content that, is defamatory, obscene,
pornographic, gratuitously violent or otherwise offensive. |
This
will apply to us as the content that we will be producing may be sensitive to
our audience, meaning that we will have to put a disclaimer before the actual
recording to make the audience aware it is sensitive content that could
offend them. |
|
Slander, |
slander is a legal term used to describe defamation or the
act of harming a person or business's reputation by telling one or more
people something that is untrue and damaging about them. Slander can be the basis for a lawsuit but must be
proven by the subject in civil court. |
This
will not apply to us as we will not be mentioning any specific companies when
talking about social media. |
|
Defamation |
The term
'defamation' describes an untrue
statement that's been presented as fact and causes harm to the character of
the person it describes. If someone's
reputation is damaged because of a false statement, this statement will be
considered defamatory. |
The
statement that we may say we will use factual evidence that will be truthful
and not be untrue. |
|
Representation |
Is how media texts deal with
and present gender, age, ethnicity , national and regional identity, social
issues and events to an audience. Media texts
have the power to shape an audience's knowledge and understanding about these
important topics. |
We will
not represent gender, age, ethnicity ,
national and regional identity, social issues and events to an audience unjustly. |
